Parliament Passes Respect At Work Bill

The Federal Government has passed the Sex Discrimination and Fair Work (Respect at Work) Amendment Bill 2021. The official Passing of the bill comes in response to the recommendations made in the National Inquiry into Sexual Harassment in Australian Workplaces ‘Respect@Work Report’ some 19 months ago.

What’s the ‘Respect at work’ bill all about?

In her announcement that the bill had passed parliament, Attorney-General Michaelia Cash said “This legislation is a critical step forward and will enhance protections against sexual harassment and other forms of sex discrimination in workplaces.”

• The legislation clarifies that harassing someone on the basis of sex is prohibited and a valid reason for dismissal.
• The Fair Work Commission has been granted powers to make orders to stop sexual harassment.
• The legislation also amends the Fair Work Act to enable an employee to take compassionate leave if they (or their partner) has a miscarriage.
• The legislation gives people an extended timeframe to lodge a complaint with the Australian Human Rights Commissioner (two years, extended from six months), in recognition of victims’ fears about coming forward.
• The legislation also clarifies that the members of parliament and judges, along with and all levels of government are covered.

Whilst the government has been criticised for not going far enough, it has provided $64 million over four years to implement the changes, which should provide a pathway for Australia in meeting international human rights obligations to provide effective protection for women against sexual harassment in the workplace.

Employers should consider reviewing their policies, procedures and provide information and training for their employees.
